Which personal data does the Administrator process?

OPTIMA Dariusz Jarzębski as the controller of the personal data within the meaning of the GDPR processes in particular the following personal data:

• Personal data of job applicants (data that candidates provide to the controller in connection with participation in recruitment processes - in particular data contained in CV)
• Personal data of contractors (company data * and data of contact persons - basic data used for issuing and recording of invoices (name, tax identification number, business address) and for contact (name, surname, company name, job position, e-mail address, phone number))
• Personal data of customers - persons who conclude contracts for moving services/warehouse rental/contracts regarding storage services (name, surname, e-mail address, telephone number, home address, (loading address, delivery address, general information about transported items - applies to moving services)
• Persons sending inquiries via contact forms, e-mail and telephone (basic contact details (name, surname, e-mail address) provided by persons in relation to questions sent to the controller)

* - Company data are treated as personal data only if they allow for the identification of persons they concern. The data of share-holding companies are not treated as personal data.

On what principles does the Controller process my personal data?

The rules for processing your personal data are presented below (in particular, you will find explained who has access to them, how long they are stored and what are the legal grounds for their processing).

Personal data of job applicants

• Purposes and legal grounds for data processing Your personal data will be processed for the purposes of the recruitment process or also in case of your consent for the purposes of future recruitment processes (the legal grounds for processing this personal data are applicable legal regulations (in particular the Labor Code) and your consent)
• Data recipients The personal data may be made available to entities authorized under the provisions of law. Access to the personal data on the basis of relevant agreements may also be held by entities supporting OPTIMA Dariusz Jarzębski in the field of IT services and infrastructure.
• Storage period The personal data processed by the controller will be stored until the conclusion of the recruitment process or until you withdraw your consent in the event of data processing for the purposes of future recruitment processes.
• Voluntary/obligation to provide data Providing the personal data to the extent required by law, in particular the Labor Code is obligatory, in the remaining cases it is voluntary.

Personal data of contractors

• Purposes and legal grounds for data processing Personal data of the contractors will be processed for the purposes of performance of the contract concluded between the parties (pursuant to Article 6 paragraph 1 letter b of GDPR - processing is necessary for the performance of the contracts to which you are a party) and to fulfill the obligations imposed on the controller on the basis of applicable provisions of law (pursuant to Article 6 paragraph 1 letter c of GDPR - for compliance with a legal obligation to which the controller is subject (in particular, in the matter of issuing and storing VAT invoices), resulting i.a. from the Accounting Act and the Act on VAT. Personal data of representatives of the contractors (employees) will be processed for contact purposes, including for the purpose of establishing and conducting business relations and performance of contracts concluded with the contractors (pursuant to Article 6 paragraph 1 letter f of GDPR - the legitimate interest of the controller, which is ensuring contact with the contractor and ensuring the performance of contracts concluded with the contractors).
• Recipients of data The personal data may be made available to entities authorized under the provisions of law. The entities supporting OPTIMA Dariusz Jarzębski in the matter of IT services (in particular hosting providers) may also have access to the personal data on the basis of relevant agreements.
• Storage period The personal data of the contractors will be stored until an objection is raised against processing of the personal data.
• Voluntary/obligation to provide personal data Providing the personal data is voluntary, but necessary for conducting business relations with OPTIMA Dariusz Jarzębski and performance of contracts binding the parties.

Personal data of customers

• Purposes and legal grounds for data processing Personal data of the Principal/Tenant will be processed for purposes of performance of relevant contract (pursuant to Article 6 paragraph 1 letter b of GDPR - processing is necessary for the performance of the contracts to which you are a party) and to fulfill the obligations imposed on the controller on the basis of applicable provisions of law (pursuant to Article 6 paragraph 1 letter c of GDPR - for compliance with a legal obligation to which the controller is subject (in particular Accounting Act and the Act on VAT). The personal data may also be processed for the purpose of possible pursuing of and defense against claims (pursuant to Article 6 paragraph 1 letter f of GDPR - the legitimate interest of the data controller which is pursuing of and defense against claims)
• Recipients of data The personal data may be made available to entities authorized under the provisions of law. The entities supporting OPTIMA Dariusz Jarzębski in the matters of legal obligations (e.g. accounting office), entities and IT providers and other entities processing the personal data on behalf of OPTIMA Dariusz Jarzębski may also have access to the personal data on the basis of relevant agreements.
• Storage period The personal data of the Contractor will be stored until the expiry of claims under the relevant contract and/or during the mandatory storage period resulting from separate provisions of law, including tax regulations.
• Voluntary/obligation to provide data Providing the personal data is voluntary, but necessary to conclude the contract.
• Automated decision making/profiling OPTIMA Dariusz Jarzębski does not make decisions based on processing of the personal data carried out by automated means, including profiling.

Persons who send inquiries via contact forms, e-mail and telephone

• Purposes and legal grounds for data processing Personal data will be processed for the purpose of electronic correspondence and implementation of actions taken at your request (the basis for data processing is legitimate the interest of the controller, which is electronic correspondence and the implementation of activities taken at the request of data subjects).
• Recipients of data The personal data may be made available to entities authorized under the provisions of law. Infrastructure and IT service providers processing the personal data on behalf of OPTIMA Dariusz Jarzębski may also have access to the personal data on the basis of relevant contracts.
• Storage period The personal data processed by the controller will be stored for the duration of conducting electronic correspondence and then for archival purposes for the period specified in the office instruction of the controller.
• Voluntary/obligation to provide data Providing the personal data is voluntary, but necessary to exchange of electronic correspondence or taking actions at your request.

General rules for the processing of personal data

• Automated decision making In regard to the processing of personal data OPTIMA Dariusz Jarzębski does not make decisions carried out by automated means.
• Data processing for the purposes of pursuing of and defense against claims and keeping data statistics Personal data based on the legitimate interest of the controller may be processed by OPTIMA Dariusz Jarzębski also for the purpose of defense against claims and possible of pursuing of claims as well as for the purposes of keeping statistics.
• Data transfer outside the EEA OPTIMA Dariusz Jarzębski does not intend to transfer personal data to third countries (i.e. countries outside the European Economic Area) or to any international organizations.

What rights do I have in relation to processing my personal data by OPTIMA Dariusz Jarzębski?

You have the right to:

• request access to your personal data, right to rectification, erasure and restrictions of processing, as well as transfer your personal data
• withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
